Pedestrians and drivers in Texas should follow these regulations:

  • Drivers must yield the right-of-way to pedestrians within a crosswalk that are in the same half of the roadway as the vehicle or when a pedestrian is approaching closely enough from the opposite side of the roadway to be in danger.
  • Drivers emerging from an alley, building, private road, or driveway must yield the right of way to any pedestrian approaching on a sidewalk extending across such alley, building, private road, or driveway.
  • Pedestrians may not suddenly leave the curb and enter a crosswalk into the path of a moving vehicle that is so close the vehicle is unable to yield.
  • Pedestrians must yield the right-of-way to vehicles when crossing outside of a marked crosswalk or an unmarked crosswalk at an intersection.
  • Where traffic control devices are in operation, pedestrians may only cross between two adjacent intersections in a marked crosswalk and may only cross an intersection diagonally if authorized by a traffic control device.

Types of Pedestrian Accidents

Types of
Pedestrian Accidents

Walkers and runners can be hit by a vehicle in crowded and secluded areas alike. Unfortunately, there’s no way of casting how and when accidents will take place; however, the majority of accidents tend to have a commonality when it comes to the driver of the vehicle, and that is a failure to see the person on foot.

These tend to be the most common types of pedestrian accidents:

  • Crosswalk accidents. This occurs when a person is using a crosswalk and a vehicle fails to give him or her the right of way, striking them as a result.
  • Parking lot accidents. Typically, in parking lots, individuals are hit when a driver fails to see the individual as they move in reverse.
  • Loss of control accidents. The most dangerous type of accident is when a driver loses control of the vehicle. Pedestrians are either struck, run over, or trapped under the vehicle.

Common Causes of Accidents

Individuals on foot can be struck by a vehicle in numerous places, even in the middle of the day when the sun’s out. In fact, the majority of accidents take place on sunny days when people are out walking. Most accidents tend to be a simple lack of attention from the person behind the wheel.

Causes of pedestrian accidents include:

  • Driving under the influence of alcohol or drugs
  • Distracted driving
  • Using cell phone while driving
  • Speeding
  • Reckless driving
  • Failure to yield the right-of-way
  • Failure to see the pedestrian

Pedestrian Accidents Result in Minor to Severe Injuries

Each year, approximately 70,000 people in the U.S. are injured in a pedestrian accident, of which roughly 4,000 result in death. Even when the injury appears to be minor, victims may experience emotional suffering down the road. The impact of a car, truck, or motorcycle typically leads to bodily damage that requires medical care, physical rehabilitation, or other forms of therapies to recover or improve the victim’s condition.

Common injuries include:

  • Broken bones
  • Back and neck injuries
  • Concussions
  • Emotional trauma
  • Traumatic brain injuries (TBIs)
  • Road rash
  • Scars
  • Spinal cord injuries
  • Fractures
  • Amputations

What To Do If You’ve Been Injured in a Pedestrian Accident

Being hit by a vehicle is a scary and unimaginable situation. The aftermath of the situation can have ramifications on your body and mind for years to come. Knowing what to do and who to call can make all the difference. If you’ve been involved in a pedestrian accident, follow these steps:

  1. Move away from traffic. Assuming you’re conscious and capable of moving without assistance, move to a sidewalk or pavement where it is safe.
  2. Call the police. Immediately inform the police of your location and that you require medical attention.
  3. Gather key evidence. You’ll want to collect the name of the driver as well as his or her license plate. Additionally, you should attempt to gather information at the scene and take pictures of nearby objects including the vehicle that struck you. Make sure to notate the names of the streets where the accident took place.
  4. Seek the medical attention you require. Even if you suspect the injury was minor, it’s critical that you are examined by a medical professional.
  5. Call a pedestrian accident attorney. An attorney will provide you with the guidance you need to take action against the driver who struck you.
